By accessing or using Accu Index Check, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Service.

1. Definitions

• Service: Refers to the Google Backlink Index Checking tools and related services provided by Accu Index Check.
• User ("You", "Your"): Any individual or entity that accesses or uses the Service.

• Credits: Virtual units purchased by Users to utilize the Service for checking the index status of URLs. Typically, one (1) credit allows for one (1) URL check.
• URLs: Uniform Resource Locators (web addresses) submitted by the User to the Service for index checking.
• Account: The registered account of a User on Accu Index Check.

2. Account Registration

• To access certain features of the Service, you may be required to register for an Account.
• You must provide accurate, current, and complete information during the registration process and keep your Account information updated.
• You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
• Accu Index Check reserves the right to suspend or terminate Accounts that violate these Terms or are suspected of fraudulent or abusive activity.

3. Description of Service

• Accu Index Check provides a platform for Users to check the indexing status of URLs in the Google search engine.
• The Service may allow for bulk URL checking, recurring checks, and access to historical check data, subject to the User's purchased Credit plan and Account features.
• The Service reports the indexing status as understood by our checking mechanisms at the time of the check. Google's indexing is dynamic and can change without notice. We do not guarantee the accuracy of results from Google or control Google's indexing processes.

4. Payments, Credits, and Purchases

• The Service operates on a Credit-based system. Users must purchase Credits to perform URL index checks.
• The number of Credits required per URL check and the pricing for Credit packages are detailed on our Website's pricing page.
• Purchased Credits are generally non-refundable except as expressly stated in our Refund Policy or as required by applicable law.
• Credits do not have an expiration date unless otherwise specified at the time of purchase or as per specific promotional terms.
• All payments are processed through third-party payment gateways (e.g., Paddle, Stripe). Accu Index Check does not store your full credit card information. You agree to abide by the terms of our payment processor.
• Prices are subject to change without prior notice, but changes will not affect Credits already purchased.
• You are responsible for any applicable taxes, duties, or governmental levies associated with your purchase of Credits.

5. User Responsibilities and Acceptable Use

• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• You are solely responsible for the URLs you submit to the Service and ensuring they do not violate any laws or third-party rights.
• You agree not to submit URLs that point to illegal content, malware, phishing sites, or any content that is harmful, abusive, or infringing.
• You agree not to use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service (e.g., excessive API calls beyond permitted limits).
• Automated use of the Service (e.g., via bots or scripts) beyond the intended functionality or any official API provided by Accu Index Check is prohibited unless expressly permitted.
• You will not attempt to resell Credits or the Service without our express written permission.

6. Service Availability and Accuracy

• Accu Index Check strives to provide a reliable and accurate Service. However, we do not guarantee that the Service will always be available, uninterrupted, error-free, or that all reported data will be perfectly accurate at all times due to the dynamic nature of search engine indexes.
• The indexing status reported by the Service is based on information obtained from or about Google's index at a specific point in time. Google's actual index is proprietary and constantly changing.
• Accu Index Check is not responsible for Google's indexing decisions, nor can we influence them. The Service is a reporting tool.
• We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) with or without notice for maintenance, upgrades, or any other reason.

7. Refund Policy

• Our Refund Policy, available on our Website, governs requests for refunds and is an integral part of these Terms. Please review it carefully.
• In general, purchased Credits are non-refundable. Exceptions are detailed in the Refund Policy.

8. Prohibited Activities

• Attempting to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service.
• Using the Service for any illegal purpose, or in violation of any local, state, national, or international law.
• Misrepresenting your identity or affiliation with any person or entity.
• Transmitting any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• Reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code of the Service or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

9. Intellectual Property

• The Service and Website, including all underlying technology, software, design, text, graphics, logos, and other content ("Accu Index Check IP"), are the property of Accu Index Check or its licensors and are protected by copyright, trademark, and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, strictly in accordance with these Terms.
• You retain ownership of the list of URLs you submit. By submitting URLs, you grant us a license to process these URLs for the sole purpose of providing the Service to you.
• "Accu Index Check" and our logos are trademarks belonging to us. You may not use these trademarks without our prior written permission.

10. Disclaimer of Warranties

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ACCU INDEX CHECK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• ACCU INDEX CHECK MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.
• YOU ACKNOWLEDGE THAT THE INDEXING STATUS OF URLS IS DETERMINED BY GOOGLE AND CAN CHANGE FREQUENTLY AND WITHOUT NOTICE. ACCU INDEX CHECK DOES NOT GUARANTEE THE CONTINUOUS ACCURACY OF INDEXING INFORMATION OR ANY SPECIFIC SEO OUTCOMES.
• NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ACCU INDEX CHECK OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Limitation of Liability

• TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ACCU INDEX CHECK, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
• IN NO EVENT SHALL ACCU INDEX CHECK'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE TOTAL AMOUNT PAID BY YOU TO ACCU INDEX CHECK FOR THE SERVICE DURING THE SIX (6) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Accu Index Check, its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your submitted URLs caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

13. Modifications to Terms

• Accu Index Check reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting on our Website or sending an email to the address associated with your Account. What constitutes a material change will be determined at our sole discretion.
• By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

14. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
• Any disputes arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English. Notwithstanding the foregoing, Accu Index Check may seek injunctive or other equitable relief in any court of competent jurisdiction.

15. Severability and Waiver

• If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
• No waiver by Accu Index Check of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Accu Index Check to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
